Court Decision
  • Warning and threating letters were sent to all customers of Trivision in November 2000 by Brilliant Tiger Industrial Co., Ltd. who alleged Trivision has infringed its new utility model patent of "renewable diesel engine smoke filter device". Criminal and civil lawsuits were filed to Trivision without any hard evidences.
  • The lawsuits of patent infringement have been detailly examined and judged by Free Trade Commission (FTC) and District Courts of Taiwan. The final decisions of courts and FTC are shown as below.
    • In July of 2002, The Free Trade Commission (FTC) of Taiwan, fined Brilliant Tiger, for sending threatening letters without any evidence of patent infringement.
    • In Feb. of 2004, The lawsuit launched by Brilliant Tiger to Trivision was dismissed by District Court of Taipei County.
    • In May of 2006, The intellectual Property Office (IPO) revoked utility patent filed by Brilliant Tiger, due to patent of Brilliant Tiger has been published and put to public use, that has become known to the public prior to patent application of Brilliant Tiger.
